This Property Is not Currentlly Validly Registered With HPD

While cheking my buildings registration page with hpd it states this "THIS PROPERTY IS NOT CURRENTLY VALIDLY REGISTERED WITH HPD." I searched here on the site but couldent really determine if the property is not registered the landlord cannot initiate cases in housing court is that holdovers or non payment. How can you make the owner accountable for registering?

In general, any residential building (multiple dwelling) with 3+ apartments is required to be registered with HPD. This also covers buildings where the LL is not in residence even if there are less than 3 units. See https://www1.nyc.gov/site/hpd/owners/co ... perty.page

This is not the same thing as rent stab registration with DHCR. The two things are different. HPD registration is for ALL units, not just RS units.

From a practical standpoint, do you want the building registered? The LL can't bring non-pay cases against tenants in Housing Court, and that might be a good thing. (not sure about holdovers).

"Buildings without valid property registration are subject to civil penalties of $250-$500, may be issued Orders, and will be ineligible to certify violations, request a Code Violation Dismissal, or initiate a court action to recover possession of the premises for nonpayment of rent."

Great thanks for the information, yeah i meant with hpd not dhcr.i also noticed that my building is classified as a class h building what does this mean. I see that while looking at hpd property registration

DOB and HPD have different classification systems.

In HPD parlance, class A is permanent occupancy, Class B is transient use.

But DOB uses J1 and J2. I'm not sure what Class H is. Perhaps it's something to do with the Dept. of Finance.

Yeah i noticed that and saw it odd. I have lived in class b multiple dwellings but this one is listed as class H??. I believe in dof classification it says h1 is a hotel. But why would it that cassification be on my buildings hpd registration

Where did you see the reference to Class H? Was it in ACRIS? Or on DOB or HPD websites? That might explain it.

DOB class H are institutional occupancy, either nursing homes (or similar health care facilities) or prisons. See page 118 here: http://www.nyc.gov/html/dob/downloads/b ... bc27s3.pdf

In DOF's parlance, Hx (they're all two letter/digit codes, like HH, H1, etc.) is for various forms of hotel.

Found it. For HPD, class H is "Hereafter Converted Class A." So, looks like a building that was built before 1929 as a one or two family home, but converted to a multiple dwelling after that date. Like a townhouse that was chopped up into apartments.

Sure I saw that, but my Q to the OP was where did he see the reference to his building being Class H? You cited the DOB classification, but there might be a Class H for HPD, DOF or who knows what? Does he live in such a building? Or are the records incorrect?

Well, OK I've been vindicated. It's a HPD designation, not DOB.

HPD really makes heads spin with heretofore's and hereafter's. SO does the OP live in such a building?
