I have a question, I am behind on my rent, I owe for May, I paid April late, it was accepted by my landlord and I received a receipt for it. They sent me a 30 day notice for April and May and are planning to take me to court, holding the payment I gave them with a receipt. I read that if they accept partial payment than the eviction notice is null and void, is this correct?
Some particulars may depend where you are located and the whims of a judge (upstate they are not noted for being tenant friendly). The might also be differences for mobile homes.
Nevertheless, if you paid and have a receipt for April's rent, they I doubt they could be successful with any claim for April. You'll have to see what the court papers claim. If they claim April's rent as being unpaid, then your defense would be that April is, in fact, paid.
Whatever you do. do not let that receipt out of your sight and make copies of it.
