LL selling property and never told me

Postby erikabee » Tue Nov 30, 2004 5:28 pm

My husband and I moved into an apartment in August and the landlord never informed us that he was trying to sell the place. We didn't find out until we saw an agent snooping around. Is is required by NYS law that a LL inform a tenant that he is intending to sell the property when the tenant moves in?

First are you on a lease or month to month.
The lease will have information regarding this.
Month to month no all the landlord is required to do is give you a 30 day notice.
A dated notice that you must move out by a set date. Is legal if properly served.
A open ended letter stating you may have to move is not legal and will not hold up in court.

Old LL under no obligation to inform tenant(s) of sale. New LL will have to honor any lease as well as the security deposit.
Just because the building is sold does not release you from your lease obligations.
Also in MTM, LL with 1 month notice can raise the rent (if this is an open market rental).
