Hi -- My upstairs neighbor has caused water damage to his floor/my ceiling and wall, and I want the problem fixed. The condition is obviously in violation of the proprietary lease, but my co-op board is saying that I should handle it by suing my upstairs neighbor myself, rather than having the board simply enforce the lease, etc. Any law on this? If you happen to know, please point me in the right direction. Much appreciated.
In your previous post, you were the tenant. Only the owner should be dealing with the board. Most co-op boards only deal with the external walls etc (outside of apt.) If upstairs neighbor has been unresponsive...then owner will probably have to hire an atty to force repairs and pay for damages or at least insurance deductible. This doesn't mean that the board should not be sending a letter to the neighbor that they are creating a hazard. Comes down to what is in by laws.
