J51 and MCI; what applies?

Our landlord is putting in for MCI for a number of "improvements" to our building. The company has applied for a J51 tax abatement for some of the work, but not for the window replacement which they filed separately with DHCR.

Are new windows not eligible for a J51? THe old ones were very old indeed, and I thought this was the kind of work the tax incentives were designed for. The city PDFs suggest (I think) that it would apply to windows.

If the abatement would apply, can we insist the company file an application?
