Leases not properly signed

Postby Phil Cohen » Mon Oct 07, 2002 10:25 am

Posting this for a friend--am hard pressed for an answer myself.
He just signed a lease for his rent-stabilized apartment, and an actual person did not sign the lease for the landlord. Instead it was just printed or hand-signed, "Gotham Management Corp." or whatever. Has been this way for a few years.
Have these been valid leases and, if not, can and should he contest it (get rent rollbacks etc.)?
I tend to think so but my diligent research has found nothing on-point.

My friend has had some of the usual landlord-tenant problems, re repairs, but nothing previously concerning the lease. He just got back the lease, saw that it wasn't signed, and then that the others going back a few years weren't signed.
So he was wondering if a non-signed lease is of any consequence. Does it? Inquiring minds want to know.

Not sure if this helps, BUT...

I recently signed leases with my Management Company and on many places it was similar where they put just a sticker on...like for the Window Guards.

In my case, it is perfectly fine, although on the actual lease it IS signed by an actual person.

I would just check if your Management Company is authorized to sign for the LL.

Does it say something like Owner/Agent (on behalf of Owner) where the LL usually signs?

No, in this instance--I saw the least once, this is my recollection--in the space for LL signature it said, "Gotham Management Corp." printed in ink. No signature of a human being.
