How Many Days Late Until A Non Payment Can Be Filed

Postby inwonderofitall » Fri Nov 29, 2002 11:47 pm

Can a landlord start eviction proceedings/have grounds to start proceedings if a tenant's rent in a rent stabilized apartment is 1 or 2 days late, or if the rent payment check/money order that is received is dated 1 or 2 days after the due date (i.e. monthly rent due on the 1st, payment is dated the 3rd)?

In theory, the landlord could may a verbal demand or serve a three-day written demand on the second of the month. However, very few landlords are that impatient.

What does your lease's default clause say about late payment of rent?
