Hi folks!
I need an answer to a question for the rent-controlled tenants in our building. They just got a whopping increase in the fuel cost adjustment. I went to the local DHCR Office, and got the forms to challenge it ( which are incredibly complicated! Don't they realize these are elderly people in these apartments?) .

But, I wanted to know if there is some mechanism to have the landlord's claims of fuel usage checked. After all, the DHCR seems to go by just the figures reported by the landlord. How are these figures verified?

I believe if challenged, DHCR would request from LL copies of invoice showing dates and amount of oil delivered, in addition to copies of canceled checks paid to oil company. The amount of oil LL claims on fuel adjustment form should match up to the amount of oil delivered on those invoices.

The other part is the complex calculations involved in filinng out the form using MBR orders for each apt, so it's not surprising that disputing the calculation is difficult.
