I need some advice about a tense situation.

I live in a rent stabilized apartment. My husband's name is the only name on the lease. The lease is due to be renewed, but my husband is not available to sign a new lease. He is on active military duty.

I have durable power of attorney and signed the lease renewal by power of attorney. The landlord claims this is not acceptible or legal. Is he correct? He claims that if my husband doesn't sign it himself, he will move to evict at the end of the lease period.

Also, is my husband entitled to a renewal period extension because of his military status? I can't imagine that the court would allow an eviction because someone was serving when their lease renewal was due.

Not a court in the land.
most Landlords suck it.

Housing COurt actually has a special section for people who depend on anyone in the service. The most he can do is serve you with a notice and have it kicked out of court.

Regardless of how long it takes your husband to return, as his wife, you're entitled to succession rights.
