Lease assignment, again.

At the end of September I finished a 2 year legal sub-lease in a rent stabilized apt. During this time I had discussed the possiblilty of having the lease assinged to me with the prime tenant who is out of the country much of the time for work. The lease holder wanted to wait until he received his rent renewal form for his lease which is up 3/31/02 because he was uncertain if he would be transfered abroad permanently.
Yesterday I receive a 10 day notice to Cure for illegal occupancy.

The prime tenant has agreed to send the LL a letter asking that the lease be assigned to me.

What steps can be taken to improve my chances of having the lease assinged?

What is a likely scenario/timeline if the LL chooses not to assign the lease to me?

In a slightly new development. I've just seen the latest rent statement and the LL is still charging the Prime tenant the %10 sublet fee even though the Prime Tenant is being accused of an illegal sublet.

Does this change anything as far as asigning the lease?
