When I rented the unregulated apartment in Queens, the Landlord's agent told me the rent was $1500, but when the lease came it listed the "rent" as $1550. He said the "rent listed of $1500" is discounted $50 if the rent is paid on time. Now, as my lease is ready to run out, he is serving me with papers ordering demanding that I pay the the "back rent" consisting of these $50 late fees. I thought a court ruled that late fees are illegal? DOes anyone know the case and / or Westlaw citiation of that case that ruled that late fees are illegal? Could I use a defense that this discount plan is actually a thinly veiled attempt to make a legal late fee. I need to see the standard the Court applied for the late fee.
