Landlord refused lease in case win

Postby brasco212 » Thu Dec 10, 2020 2:35 pm

What are the rights for the Lanlord and Tenant in such a case?:

Parent died, and son wins case against landlord to take apartment in 2018.
Judge orders landlord to give successor of the apartment a lease. Landlord has not given a lease yet. tenant has held and saved rent from May 2018 then until now December 2020. Some action was taken Dec 2020 against tenant for unpaid rent, it was overturned by judge and ordered Landlord to give a lease.

If a lease is given, Can the landlord still sue for money last 2 years rent in another case for use and occupancy?

You don't tell us a lot. Is the unit rent stabilized? What sort of case was it? What does "to take apartment" mean? If a court case, was it entered properly? Did the son have a lawyer?

When did the parent(s) die? Did the some live with the parent(s) prior to their passing and for how long (this is important).

I seem to remember seeing cases where the person in occupancy does not owe any rent until the LL provides a lease. But there should be research on that. If this is the law, then the tenant would not owe rent for those two years. But again, all details may be important here.

You say there has been a case this month? Details? What was overturned? You have to givce us details; we are not mind-readers.
