Withholding Rent Question

Posted by John Scarlata on October 29, 1999 at 16:03:47:

i live in a full service high rise on the upper east side, managemd by the
Glenwood Management company. My monthly rent is in excess of 2000 dollars.
Over the course of one month we experienced a very bad leak from our
bathroom ceiling, which was directly over the toilet. We would notify the
doorman, who would send up a maintenance person, this person would look at the
leak, then go upstairs, then come back and say there was no leak above us and
go on his way. This went on until we had to contact the manamgement company
directly because conversations with the on-site manager led to more frustration
than was necessary to fix a leak. The on-site manager would actually raise her
voice and hang up on my wife. finally the management team sent some people to
fix the leak. On three occasions we were told the leak was fixed, only to be
woken up at night by the forever dripping water. Now the leak got worse, it was
in the wall AND the ceiling, and now the water was running behind the medicine
cabinet, running out in a very lovely RUST color, all over the sink and counter.
Anyway, the leak is fixed, and a week later they came and fixed the damage.
I want to know what my right is to withhold rent for each day that the leak was
not fixed i've been told to withhold all of the rent. what am i entitled to?
all in all it was about 22 days that we dealt with this problem. I mean, 3
buckets collecting water thru the night, into the morning, for 22 days. Having
to use the toilet with a constant drip of dirty water on your head...lovely, all
this for over 2K per month for a small one bedroom.
