no: letting you use your security will not stop him from winning this one. you'll need to show that it was clean, only normal wear & tear, etc. did they paint less than three years earlier? or tis that just for NYC?

don't know why, but, the Small Claims info is hiding under NYC Housing Court info on the first page of http://tenant.net. so go there and read it. also read the nolo.com section, and go to www.nolo.com.

pps: use the search engine on this forum: lots of people ask about this, usually because the landlord refuses to return the security, try that word. oh! yeah! search for 'small claims' also.
