: Rented a small apartment in Cobleskill, NY. No lease. Only 4 units in building. I left
: because of cockroaches. Landlord accepted security as last month rent. 2 mos.
: after I left police called me in and told me landlord was now claiming $350 in
: damages. (painting) Now, 2 mos. after that encounter I am to appear in small
: claims court for $690. (painting, wallboard, garbage removal) Doesn't his acceptance of
: security for rent acknowledge that there was no damage to apartment? He certainly had been in
: it enough to know what condition it was in while we were there.

no: letting you use your security will not stop him from winning this one. you'll need to show that it was clean, only normal wear & tear, etc. did they paint less than three years earlier? or tis that just for NYC?

don't know why, but, the Small Claims info is hiding under NYC Housing Court info on the first page of so go there and read it. also read the section, and go to

ps: tell your mom hello!

pps: use the search engine on this forum: lots of people ask about this, usually because the landlord refuses to return the security, try that word. oh! yeah! search for 'small claims' also.
