You have a little time to sign and return your renewal lease. First, you can only go back 4 years in rent history. It gets complicated if the LL hasn't filed (registered) the rent. But assuming LL has filed, you look at the rent filed (registered)in 1997. That's what your overcharge will be based upon. How long have you lived in that apt? I don't know what 1970 has to do with it. Look from 1997 on. What was your rent when you first moved in? What year did you move in? Need more info from you. How much is/was your rent on the lease that's expiring?
DHCR is under Pataki's thumb. The attitude within DHCR really started changing in 1995. Unofficially, caseworkers are encourged to discourage tenants from filing overcharges, amongst other things. This is straight from the proverbial "horses mouth".
