In her original question, Lucia wrote, "We have been tenants of this building for 2 years with a month-to-month lease that looked very suspicious to us from the first minute we saw it. We tried to get a one year lease but they would not agree so we signed it anyway and hoped that everything would be ok."
It would appear that the apartment is not rent stabilized, but the tenant should have checked this out shortly after she signed the lease and moved in. The only two relevant issues clearly are: (1) does the building have four units or more? or (2) if the building has fewer than four units, does the landlord live in the building?

: Well, if the apartment were in fact rent-stabilized the tenants could not evicted on a few days notice, yes?
