The lease issue I've answered in your other question. In a multiple dwelling with 6 or more units, the security deposit must be held in an escrow account for you.

Regarding painting the apartment, you have answered your own question. You
accepted the apartment "as is", meaning without fresh paint. The landlord
in entitled to raise rent between tenants in either a rent stabilized or
market rate situation.
