Rent stabilized landlords requirements in mold remediation?

Postby ellentk » Mon Apr 09, 2018 10:49 am

I live in a rent-stabilized apartment in need of some mold remediation.

I worked with a mold remediation expert some years ago and know what's required to do it properly. But I don't know how many of these requirements a New York City rent stabilize landlord is required to follow.

For instance, must the landlord hire a NYS licensed mold remediation contractor, and then require the contractor to set up negative air and use the proper protective sheeting?

I know that my landlord will fix the problem cosmetically but I don't know if he would be willing to do it properly without my showing him the law. So I'm writing here to find out what law applies. (Of course, my first choice would be to ask my expert friend for his help with this problem, but unfortunately he's passed away.)

I can't give you an actual answer, but here's one article about the "underlying conditions" bill that was at City Council. http://www.nydailynews.com/new-york/bil ... -1.2007538

Thanks. My landlord will do it. He's already fixed the leaks (which are the underlying conditions). I just want to find out if he's obligated to do it properly.

There's no law that defines "properly," however from time to time you will see references to good workmanship. But still, that's interpretive.

Bottom line is that if the problem recurs, you can complain again. And if it gets to court, you can ask the judge to order the LL to take certain steps. But be prepared to have an expert witness testify what those steps ought to be.

Thanks. I'll check with the city agency(ies?) that regulate mold removal and post back here in case someone else has the same question.
