Illegal Sublet in Co-Op Involving Social Services

Sorry for the long post. There is a situation that's causing a safety concern with shareholders in the co-op where I live.

A shareholder, who does not reside in the building, has illegally subletted his apartment, violating the rules and regulation of the proprietary lease. His "tenant" moved in August. Both parties were notified that this was an illegal sublet, and a 30-day notice to cure was issued to the shareholder. That notice has since expired.

We've learned that the "tenant" is someone who is receiving benefits and housing assistance from Social Services. Social Services never initiated a screening for this guy, nor did they speak with Management or the Board prior to his move into the building. When Management finally spoke to a case worker, they were told that that shareholder had to return money to them for the guy's rent and they will get him a new place. However, that conversation was back in September, and the shareholder hasn't done anything.

The Board has made all attempts to resolve the issue amicably with the shareholder, and now has had to begin proceedings to revoke the proprietary lease. In the meantime, his "tenant" has begun to start trouble with Management and the Board. He, the "tenant," lost the lobby entry key and demanded that Management give him a new one. They told him that would not be possible. It has to be requested by the shareholder, which was not done. The Board has also refused the request. The "tenant" was reminded that he was illegally in the apartment, and nothing can be done to assist him by Management or the Board. Everything would need to be done through the shareholder.

In the last 2 days, there have been 3 volatile, though not violent, altercations caused by the "tenant." During the last one, he was acting in a threatening manner against the managing agent (female). I, along with 3 other shareholders were witness to this, and we even had to step in to assist. Other shareholders also heard the altercations and have expressed issues of concern about their safety around this guy.

Since the notice to cure has expired, is there a way to have this guy legally removed from the property?

And you claim the tenant is causing trouble by losing a key? Perhaps he will next cause more trouble by shivering from lack of heat?

Yeah, you got that right. Very wrong website. I came on here to get info on a situation that concerns shareholders. I guess shareholders aren't welcomed to ask for advice.

Oh and thank you for totally misreading and misunderstanding the entire post.

This is TenantNet, not LandlordNet or CoopNet.

And complaining about a tenant's receiving social services, in addition to being nosy, stinks of classism or perhaps worse. Shame on you.
