Amount of porters, as well as the Super in an HDFC Co-op

Postby Soulman1015 » Thu Dec 13, 2007 2:33 pm

Hello,

I live in an HFDC coop, which has 60 units. Most are shareholder owned, but there are a couple that are subleased, a couple that are rentals, and a couple that are Section 8.

However my question is, I know we have to have a Super, but don't there have to be other porters as well? The "super" that we have definitely have nothing super about him. He doesn't do the work that he is supposed to do, and he gets bogged down on many things and doesn't have enough time to do them all.

How many maintenance people does such a building need in order to effectively maintain the building. It's getting worse and worse!

Thanks,

From Article 22 of the NYC Housing Maintenance Code
http://www.tenant.net/Other_Laws/HMC/hmc002.txt

Sec. D26-22.05 Residence of person performing janitorial
services; limitation on number of dwelling units served

The person who performs janitorial services for a multiple
dwelling of nine or more dwelling units (other than where
janitorial services are performed on a 24-hour-a-day basis under
section D26-22.03 (b)(3) shall reside in or within a distance of
one block or 200 feet from the dwelling, whichever is greater,
unless the owner resides in the multiple dwelling. Where two or
three multiple dwellings are connected or adjoining, it shall be
sufficient, however, that the person who performs janitorial
services resides in one of these, but no person who performs
janitorial services for more than one multiple dwelling may
service more than 65 dwelling units. Regardless of residence the
janitor must have a telephone where the janitor may reasonably be
expected to be reached. (Amended by L. L 1978, No. 28, Sept. 14.)

Bottom line, however, is that, with 60 units, you only need one super, according to the law.

It's a co-op, though - the corporation can always hire more staff, assuming there's support among the shareholders...

Even if one janitor is enough for the number of units in the building, the law requires the owner to provide "adequate janitorial services" including cleaning and maintenance, not just what is within the capabilities of one person or the particular super in question.

See NYC Housing Maintenance Code sections D26-10.01, D26-11.01, D26-11.03, D26-14.05, D26-22.01, and D26-22.03 (a): http://tenant.net/Other_Laws/HMC/new/index.html
