Security deposit return/repairs made. Are receipts required?

Postby sticker34 » Thu Jan 17, 2013 1:21 pm

Our old landlords mailed our security deposit check, less the cost of repairs. None of the repairs are being disputed, they were all agreed upon during the final walk through. The cost of repairs, however, seem quite inflated and we would like receipts furnished, and a breakdown of labor if charged.

Is this within our rights? Can a landlord send an itemized statement without backup and have that stand? They are ignoring our request for receipts as of now. We have not deposited the check they mailed.

Any advice is appreciated! Thanks!

You can challenge the failure to return all or part of the deposit in Small Claims Court. The LL would be able to sub,it receipts in his defense.

You should be able to cash the check if you mention in the memo field that it is without prejudice to your making a claim for the remainder of the deposit. Make copies and document everything.
