tenants rights to refuse exterminator

Postby m54 » Wed Jun 15, 2011 12:09 am

Hi

I just moved into a new apartment about a month ago and as soon as I moved in, I started to have hives. My landlord have exterminator to spray for roaches every month for over 30 years and I think I'm having allergic reaction to this chemical. I told her about my health condition but she just yelled at me that she had never got complained (this is 3 family house and I'm renting the 3rd floor) and told me I'm allergic to something else.

I went to immunologist and tested that I'm a very allergic person, so he wrote doctors note to stop spraying. I haven't send her the document yet, but if she refused to spray, do I have rights to break the lease?

Thank you in advance.
