Does anyone know at what point a landlord can issue a subpoena to third parties to turn over documents? Can they do it as simultaneously with beginning the eviction process or do they have to wait until a trial is set or at some point later in the process?

We're not attorneys and can't give you the absolute rules on this. But take a look at http://caselaw.findlaw.com/ny-civil-court/1072853.html -- you might find it instructive. Let us know if your case is similar of has the same landlord attorney.
