My lease has a clause in it that says in case of a lawsuit between LL / Tenant, legal fees are recoverable by the victor. Given the lease also overcharges me significantly above the legal rent.

My question is this: in an overcharge case in civil court under what conditions are legal fees recoverable? Is it embedded in the law anywhere? Does my lease clause help me?
