Postby cossack » Tue May 07, 2002 12:09 am

Help!
My Sig Other wanted to move. She found a house. Her and landlord signed a lease to take occupancy on the 1st of next month. Paid deposit and check was cashed. Hired movers for the 31st. She then gave her 30 day to her current landlord.

The previous tennant had given landlord 30 day notice.

Now the previous tennant refuses to move. My love has no home after the 31st. What are her leagal options?

Mansfield Ohio, Richland county.

I'm not a lawyer, but...
Basically, new LL has breached contract, as unit is not ready as promised, and would probably be found responsible for all damages (out of pocket expenses).
-You can cancel the lease and ask for your money back. contract law states that if goods (apt.) is not delivered on date promised, contract is automatically void and money must be returned.
-You can stay at a hotel or friend's until apt is ready and deduct it from your rent when you finally do move in (-not a good way to start out)
-You can urge the new LL to evict the tenant
These are just my suggestions...
