What is the chain of Command in Housing Court?

Postby sidam » Wed May 15, 2002 3:00 pm

I went through Housing court and three weeks later I'm still waiting for a decision on an illegal eviction. This is maddness. I would like to go above the judge's head with a complaint. Is there any complaint process for a judge who drags his feet on a decision? Any links to web sites, names, and resources would be great.

I wouldn't dare, and don't you either. Go down to housing court and pull your file-maybe there's something in there. You will of course file an appeal if the decision goes against you.

In addition to following Lilly's advice, you could contact the Administrative Judge for Housing Court or for Civil Court, to see if the housing court judge deciding your case could be persuaded to speed up his/her decision.

Another alternative is to bring an Article 78 proceeding in state Supreme Court to force the housing court judge to issue a decision.

The second alternative can be very expensive, and both alternatives could cause the housing court judge to decide against you.
