security deposit

Postby sarah smith » Tue Mar 26, 2002 7:22 pm

Our old landlord has sent us a ridiculously long list of damages/ repairs/maintenance he claims we are responsible for and is in process of calculating how much he is going to charge us & deduct from our security deposit (which, it seems, could be the whole lot!)

Most of what he claims is just not true, but we have no evidence to prove otherwise. Is there anything we can do to dispute this, or any measures we could take (in advance of taking him to court)? Any advice on free lawyers advice or other organisations to contact would be enormously appreciated.

Thank you.

Well you should have taken photos, gotten witnesses and done a walk-through before you left. Even so, it's the landlord's obligation to prove the damages. Also, some things he may list are really normal wear and tear. Don't let him get away with things like cleaning carpets, etc. It's only for real damages beyond what would normally be expected in the course of a tenancy.
