But obviously tenants, or occupants, are entitled to have guests, whether they're related or not. So this just brings us back to the question of when does a guest become an occupant.

I would think a variety of factors would need to be looked at -- there would not necessarily be a single determinent. One would be if the "guest" paid rent (or "use & occupancy" as rent implies a landlord tenant legal relationship). Another might be the length of the stay, although I can very easily imagine scenarios where a gues would stay beyond 30 days -- the time period usually cited where a person acquires tenancy rights. The nature of the agreement would be that of guest and not that of a roommate (a licensee situation). Although it would be unlikely there would be a written agreement with a guest. Another would be that the tenant is still in occupancy. That seems obvious, but guest often get confused (by LLs) with sublets. We're not speaking of apartment sitters -- that's a different thing altogether.

I would also imagine that a guest wouldn't complain to management, arrange repairs, or demand whatever other services a tenant is normally entitled to.
