Help! What's the law on move out date...

Postby ainsley16 » Wed May 08, 2002 10:24 am

I live in a rent stabilized hotel. My lease says I can leave with 2 weeks notice. I gave notice and now my landlord says I have to stay 3 1/2 weeks until the end of the month. He says that the law states that my tenancy is monthly. Does anyone know if that's correct? Thanks.

A month-to-month tenant in New York City doesn't have to give any notice to terminate the tenancy.

If you are not a month-to-month tenant, because you live in a rent stabilized hotel unit, your lease provision requiring you to give only two-weeks' notice should govern.
