Can a rentStablized unit apply for section 8

Postby Cylon452 » Fri Dec 24, 2021 6:56 am

I was wondering because i have a low income and already live in a RS unit.
So is it possible i can qualify for section 8 ?

Can i say to HUD i already have a RS unit and like a section 8 voucher no waiting list required us my current address.

Can i say to the building owner i now have a section 8 voucher please take it.
Can the building owner reject a section 8 voucher ?
Can the building owner reject my Voucher at anytime after he accepts it ?

My lease is on RTP-8 form. Is this going to be an issue with section 8 ?

Are there any downsides to section 8 as a RS tenant ?

Will i lose my RS status on section 8?

Thanks
I know this is a lot of questions but i'm sure some of our RS members here would like to know.

To most of these questions, we don't know as we're not Section 8 experts. Have you searched the net, start here:
https://www.hud.gov/topics/housing_choi ... _section_8

and these URLs:

Much of Section 8 in NYC is NYCHA, but there are vouchers for tenants in private apartments.

Can you convert to Section 8 in an apartment in which you already reside? That I don't know.

I do know some landlords will move heaven and earth to avoid Section 8 tenants, but AFAIK that's now illegal. As you already reside in the apartment, they might come up with other fibs. Do best to do all your research before mentioning this to the LL. And of course, document everything: letters (and envelopes), emails, even record phone conversations.

Your lease is not on the RTP-8 form. That is the renewal, not the original lease when you moved in. You should find that and read the fine print just to be familiar with it. Even so, remember, these comes from LLs and often contain illegal provisions.

Sure, it's no problem for an RS tenant to apply for S8. Nor does S8 "convert" your RS unit to some other status. Just be sure to send all your lease documentation to the Section 8 people.

It may be that simple, but do your research first and get everything in writing.

It's not always "no problem." As I said, we often hear about LLs refusing to accept vouchers and even then taking tenants to court for non-payment. That's harassment. Of course that wouldn't happen in NYC, now would it?
