Water Damage, LL should or not?

I apologize for this question may have been posted in here many times already... Should my LL responsible for the reimbursements my water damaged items?

Now the water leak has been controlled and repaired but we are no longer want to keep the soaked rug and runner, I asked my LL to give me a reimbursements for the replacement, he motioned for an acknowledgement, however late on as I sent him an invoice, he replied, " We are not obligated to replace your older runner with your purchase of a brand new carpet".

Do I have a case? I have a rent stabilized apartment.

Was the damage caused by the LL's negligence? Did he know about the problem and fail to make repairs?

Was the rug supplied with the apartment, or is it something you bought? Your post however is confusing.

Do you have renter's insurance? (all tenants should).

Forgive me I did not know how to put these prior to the post:

- The pipe was too old.
- We bought these rugs
- Our family do not have a renter insurance, does my LL has on us, we did not know.

Unless you can show LL negligence, you might be out-of-luck. If the LL is willing to negotiate or pay partial damages, consider that. Negligence is when the LL knew of a problem and ignored it. Otherwise, buildings are old and things happen. A pipe being old is not negligence.

Consider getting renter's insurance. I pay around $140 per year, and it's worthwhile for situations like this. I use a major insurance carrier, but do your own investigation and get something that works for you.

I'm on a higher floor, so I didn't get the flood add-on. You can mix and match different things, i.e., flood, earthquake and so on. Also if you have electronics/computers that you use in a business, there are riders for that as well. Of course keep receipts of everything that you purchase.
