RS Lease Renewal late

Postby backhoe » Mon Sep 17, 2018 8:41 am

I am a rent stabilized tenant, and my lease ends Dec. 31. Usually renewal leases arrive in August. So far, none, and they are supposed to come by Oct. 1. Is there any point in dropping a line to the managing agent reminding them?

First see the instructions on page 2 of the DHCR form RTP-8. This describes the procedure for renewal.

The LL is supposed to send you a renewal lease between 150 and 90 days before the lease expires. So with a Dec 31 expiry, then it should come by Oct 1 at the latest.

Sure, you can always ask them, but only you know if the LL is doing something like trying to get you out, or mad at you for some reason.

The good thing is that if they refuse to renew you lease, you are still a RS tenant and your rent does not go up until they renew it.

Well I am a longtime tenant and have filed complaints against them and have a DHCR reduction in services complaint pending. But there is nothing new in that. I just thought it would be the amicable thing to do, send a note or email saying the renewal is due, but the more I think about it the more I wonder, why tell them their business? I'm well aware that lease renewals in RS apts are just a formality.

Well I was wavering, which was why I posted here, but I am seeing less and less point in sending over a note. If he is going to try some monkey business---which I doubt but you can never exclude that possibility---sending over a note may be interpreted as a sign of weakness.
