owner occupancy scam in stabilized apt.

Postby NoMoreAds » Wed Dec 07, 2016 12:44 am

Hi
A landlord wins back a rent stabilized apt claiming owner occupancy.
Owner part time lives in apt for less than 2 years.
Original tenant sues claiming owner occupancy was a sham and wins back apt.
In a situation like this, does the landlord lose the right to ever increase the rent of the original tenant?
What about other stabilized units in the building? Can LL still raise rents there?
Thanks for any advice.

I think the answer is in the DHCR Fact Sheet on Owner Occupancy
http://www.nyshcr.org/rent/factsheets/orafac10.pdf

See the third paragraph.
