Landlord's Attorney fee / 80% carpet

Postby gosmile77 » Wed Oct 28, 2009 4:39 pm

HI,

Our lease states "any legal fees and disbursements for legal actions or proceedings brought by Owner against You because of a Lease default by You..."

I heard that no one really enforces 80% carpet rule since it has to be uniformly enforced to everyone in the building. The apartment was advertised to have a "beautiful hardwood floors". My question is, if the case goes to the court and that the court agrees with the LL that I need to have a carpet, can they then ask me to pay for their legal fees as well.

Under what other situations, can the court ask the tenant to pay for the LL's legal fees?

Thank you in advance.
