move out notice / security deposit

hope you could advice me on this.
we moved to this apt in islip last oct 2007, it is on a month-to-month lease and we are paying every 1st of the month. last mar 8, 2008 we receive a moving out notice for april 30. on mar 11 my father-in-law died and we decided to go home to our home country and leave the apt, we gave a verbal notice, packed all our stuff & turned-over the key last mar 14. i learned recently that the apt has no rental permit. can someone pls tell me if there is still a way to get my one month security deposit and/or my 2 wks for the month of march?
i don't know the rulings on this matter. thanks in advance.
