i get keys and simultaneously agree to pay 2 months in full by following wk.

then LL calls next day to tell me that i cant move in til he gets full 2 months.

do i have possession?

i never set foot in after getting keys on first day...

Legally, you may not.

But posession is 9/10s of the law. If you have the keys, I don't think there is any practical way for LL to prevent you from moving in.

Are you Rent Stabilized?

If RS LL is only allowed to charge you the first months rent, and a security deposit equal to 1 months rent. Make sure you are not overpaying.

Do you want the apt or not?

If not: give LL back the keys & hope that LL gives back most of your $$$.

If you want the apt, pay one more month & move in: you paid 1 mo sec dep, LL wants the 1st mo rent.
