Eviction procedure help!

Postby ronin » Mon Sep 22, 2003 12:11 am

Hi,

A tenant got evicted last week by Marshal Essock.
They changed her locks and stuck up a notice saying
the LL has possession.

A day later a moving van rolls up and they moved
all of her stuff out. She says she witnessed them
trashing her property, and that one mover was
playing with her undergarments in a lewd manner.

The LL told her he decided to move her stuff
and that he had paid a month's storage.

Isn't the LL required to leave the apartment and
property alone for 30 days unless the Marshal
removes the items during the eviction?

Put another way, isnt the LL supposed to pay the
Marshal to supervise the removal of items? And
what recourse would a tenant have for a violation?

Thanks.

Wow! This is excellent consigliere, thanks for the link- I'll be using it frequently. I read through the section on evictions and it is very detailed as to what the marshal must do when removing items, but not what the LL can't do. For instance a marshal has to use a licensed storage place, does a LL? (Actually, Ive heard the marshals all use the same rip off storage company that charges outrageous rates- so this may not matter).

But I still don't know if a LL can remove stuff after the marshal gives them possession? Or what those limits are.
