Help me with this, please

Postby Patty25 » Sat Apr 15, 2006 12:59 am

We have a new landlord few months ago. I know I am paying below the market, but I cannot afford what the new landlord is asking me. I haven't paid him because I want to save money until I move out. I got a notice that I have to go to court. What should I do?

Do you have a lease?
Are you rent regulated (RR/RS) or open market.
Either way will have to go to court. Need more info to determine if raise is legit.
How were papers served?

I don't have a lease, and I don't have rent regulated. The papers were under my door.

If you did not pay the rent, your LL has the right to sue you for possession of the apt and the unpaid rent.

However, the new LL might not be legally able to collect rent you owe to the old LL (it's complicated, learn the basics first).

Do you know when the bldg was sold? check the deed on ACRIS (search, above left, for that)

Did you fail to pay rent before or after the sale or both?

Learn the basics re the Housing Court process:
http://www.tenant.net/Court/cwtfhc/index.html
http://www.tenant.net/Court/Howcourt/contents.html

To increase rent for NYC MTM T, LL must send 30-day notice as described in RPL 232-a, scan forum topics for very recent thread on this issue and/or search, above left, for RPL 232-a.

Is this an apt in a 2- or 3-family house? Is this a legal apt?
