Serving papers 5-12 days and court date questions

1) When serving papers, which days are considered in the time frame? Everyday? Only business days? Ex: Papers must be served 5-12 days before the court date. What days can be counted in those 5-12 days?

2) If issue is resolved before the court date, do I just go back to the clerk and withdraw the case or is there something special I need to do?

Sounds like you're the landlord. So you're in the wrong place. This is TENANT .net. You should probably consult with a landlord attorney.

I'm actually a prime tenant and this is a roommate holdover case, I just thought phrasing my questions that way would be simpler.

You would still be better off with legal help.Getting someone out - even if you have just cause - has a lot of pitfalls.
