Wall and door in dining room - legal convertion?

i planned to rent one unit of a legal 2 family house in Queens New york.
It is very nice but one problem.
The owner just finished renovation for new tenent. he put a wall with a door in dining room, so the dining room will not be visible from stair. he was planing to covert a dinning room to be a bed room.
Although it is not dividing room to be 2, but it is a convertion
If this is legal? If building dept come to inspect this house, and wall has to be take off?
I know landlord trys to get higher rent from it.
if i rent it, i think he will not decrease the rent if the wall got removed in future.

This is a DOB issue. He would need to have filed a permit. Go to the DOB website; type in the address of the building and see if there was a permit.
