Getting kicked out. subleasing overcharges section 8.

I have lived in Williamsburg for 4 years paying 2300 for a 2BR. last year I found out it was rent regulated or something and I was being charger 1k over the regular rent. I started paying the landlord directly for past year 1200 per month. just found out it is section 8 housing and they can't even offer me a lease as far as I know.

I really don't want to move. but I am not section 8 person... happy to pay 2300 or more if I had to. really don't want to move. any advise?

I would start by getting more information. You seem unclear as to the actual status: maybe this and maybe that, or something.

Did you file an overcharge, or lease complaint with DHCR? Without a legal determination, you could be on the hook for what the LL will claim is unpaid rent if he decides to take you to court.

Section 8 is not our specialty, so I really can't offer advice about that.

I would consult with a tenant attorney, or a tenant clinic where they can look at your documentation (or lack of it) and offer better advice.
