Rent Regulated, SCRIE

I looked up the building of which I rent an apartment on HPDOnline. It's listed as "rent regulated" ? Does that have the same meaning as "rent stabilized" ? I know that the apartment
is not "rent controlled" (but it used to be).

If a building is "rent stabilized", are senior tenants elligible for SCRIE rent freeze ?

This is what government and the press get wrong, in some cases by intention. But it leads to confusion.

There is no such thing as a rent stabilized or rent regulated building.

"Rent Regulation" refers to both RC and RS.

Many - if not most - buildings have a mix of units, some RS, some (fewer and fewer) RC and some unregulated. So if your building has any unregulated units, would you call it an unregulated building?

Rent regulation applies to each unit, not to the building. When they say it's a RS building, they mean that some (even one) of the units is RS. It further means that there are 6+ units in the building and constructed prior to 1947 (for RC) or 1974 (for RS). So those are predicate requirements for the building. But each unit is either RS or not based on further criterea, including high rent and high income deregulation.

So to answer your question, if the unit is RS, then it's eligible for SCRIE. I think it also works for RC, HDFC and Mitchell-Lama units, but ask the SCRIE office about that. So notwithstanding that HPD has incorrectly labeled the [complete] building as being rent regulated, SCRIE would not apply to any unregulated units within the building.

Thanks for the info! It's surprising how tricky this stuff is.

Is there a way I can find out if the apartment unit I live in is technically "rent regulated/rent
stabilized" without asking the landlord?
