We have historically had trash bins in the vestibule area of our apartment (small walk-up building). It was really nasty--no argument. There is a business that would put stuff out there that was disgusting.

Anyway, the landlord's solution--and he doesn't give a crap about all our complaints over the years, it's just that he recently couldn't get the rent he wanted because of it--is to limit the times we can deposit garbage to three days a week, all at offbeat times (5-7 in the afternoon on two weekdays, and early in the morning on Sunday).

So we'll have extremely limited opportunities to tip our trash. We have to go into a small space that is rented by the business to do it, and the door would be locked at all other times. Looks like I'll have a once a week chance to get rid of rubbish since I work late.

This strikes me as bizarre.

Does anyone know if there are any regulations around topics like this? Locking up the trash bins is a new one to me and forcing apartment dwellers to warehouse garbage and follow an unreasonable schedule is ridiculous.

Check the Housing Maintenance Code and Multiple Dwelling Law (links above). I believe it's illegal.

You could always put trash out on the curb (make sure nothing that identifies you is in it) and then call Sanitation to give the LL a ticket.

I like your second idea a lot.

Anyhow, this seems pretty straightforward, especially considering most laws are written in such a way that it's anyone's guess!

c. In multiple dwellings where no dumbwaiter service is provided, the owner shall provide between the hours of seven a.m. and ten a.m. or between five p.m. and eight p.m. daily:

(1) a sufficient number of receptacles but in no event less than two within the dwelling or other area approved by the department, which are accessible to the tenants. Such receptacles shall be removed promptly upon the expiration of the selected time period and taken to their place of storage; or

(2) a pick-up service at each dwelling unit to collect ashes and wastes for deposit in the receptacles referred to in section 27-2021 of this article. The owner shall post and maintain a notice in a conspicuous place in the dwelling informing the tenants of the hour and method of collection. A new notice shall be posted and maintained within 48 hours preceding any change in such hour or method.

One poster suggested that if the tenant can be identified the LL can take the tenant to court based on causing a violation. That might be something to consider, however in this instance the LL is in violation for not providing acceptable trash disposal facilities.

In our view, one (the LL) should not benefit from their own wrongs. This is an instance where the LL is clearly in the wrong; we're not suggesting tenants do this when adequate facilities are provided.
