Illegal Conversion\OccupancyRequirements

I live in a building that, according to the DOB, is registered as and has a C|O that covers a 2 family private dwelling. 5 years ago it was converted (without obtaining DOB permits) into 4 apartments. It is a wood frame house. There is only one means of egress from the top two floors. No fire escape,sprinklers or roof access. The LL recently removed the "3rd" tenant that would qualify it as a Multiple dwelling. The place has been used as a multiple dwelling for the past 4 years(i have leases to prove)Does it matter how many apartments are currently occupied? is it Defacto MD? I would like to know for sure that the rent bar applies here?
