The distinction is between Class A and Class B multiple dwellings and the different laws controlling their use, such as the building code's Certificate of Occupancy.
Perhaps the correct name for the B&B apartments is "hotel", but "flophouse" has a certain ring of poetic justice to it! Headline: "landlord subverts Rent Stab laws to run flophouse!!" Of course, the permanent residents might not appreciate that...
