In Reply to: MARSHAL'S WARRANT IS DEFECTIVE, NEW OWNER NOT JOINED AS A PARTY AS LANDLORD posted by jamie on February 21, 1999 at 15:40:00:
The old landlord is not entitled to execute on the judgment because it no longer owns the building. The new landlord is not entitled to execute on the judgment because it is not named on the warrant. Therefore, any execution of the warrant would constitute an illegal eviction. Our law firm is now pursuing a claim for damages against a landlord in just this fact pattern.
