: I am sharing a one bedroom apartment in Queens, NY with a friend. The lease is
: under my name. My roommate's mother decided to make a set of keys
: to the apartment and moved in without discussing it with me first. At first
: I was understanding. I let her stay in our apartment without any arguement,
: rent-free. It's been 3 months now, she's still here. She's a very rude and
: demanding guest. I want her out. She will not leave and insists that she has
: rights to stay here. She has established a relationship with the landlord since
: the first day of the lease. Now she screams at me and declares that this is her
: apartment because she found the apartment for us in the papers although she
: doesn't pay any rent. This has turned real ugly. Do I have the right to throw
: her out and change the locks? I can not live like this. Please help!
You are your roommate's landlord but she does not have a legal right to have her mother move in. However, if she has lived there for more than 30 consecutive days, you most likely have to sue her for eviction in Housing Court to get her out. Read about Illegal Lockouts and Housing Court on TenantNet Home. Try using the effective complaint letter procedure outlined on TN. And/or: go to a lawyer or local tenant group or the landlord table at Housing Court for more help.
