: Well you could not renew their lease or raise the rent $500 a month and
: they will move out....

: Or put it in the NEXT lease no smoking, and make it a medical problem like
: you have asthma or are allergic to cigarette smoke... and if they are dishonest
: And you will have to hire an outside contractor at higher rates to pay for any repairs, and they will be responsible for the cost

: If they have no lease then evict them, give them 30 days notice on
: Dec 1 st and they will have to be out Jan 1st.

look, if you could not tell that he smoked before he moved in, your not allergic.
put in extra smoke detectors and next time, ask first.
: If you live there then YOU have LOTS of rights to demand NO SMOKING, but if you rent Both apts.
: then you have to wait and not renew the lease.

: : I'm a LL of two family house in Brooklyn. The real estate that sold the house to us also found tents for us.
: : We told the real estate we did not want smokers. A family of three moved in they have been there under a year.
: : Turns out the farther smokes and try's to hide it by hanging out the window . I have seen him smoke out side the house in passing.
: : How do I approach this without making a trouble?
