Forgot to take my name off of lease

Posted by AJ on October 09, 1999 at 16:50:47:

Can anybody tell me what to do about my situation? I live in California,
and several years ago rented a house with my husband who is now my Ex-husband.
When we separated, I left the house, but forgot to take my name off of the
lease. He lived in the house another 2 years before he was eventually evicted
for not paying his rent. Now, it's been five years since then, and to my surprise,
I recieve a wage garnishment for a judgement our landlords got for the back rent.
I was never served with any papers (they sent the papers to the rental house,
and if my ex ever got them, he never told me), and didn't even know there was
a lawsuit or I would have fought it then. The landlords knew I had moved out, and
even told my ex they would take my name off the lease, but never did.

My ex says he will take over the payments so my wages won't be garnished,
but I still have this collection and judgement on my credit report. Not to mention
the fact that my workplace is not happy about the garnishment, even if it does
end up being stopped. Do I have any recourse here, or am I screwed? Can I get
the judgement against me overturned? Can I or should I counter-sue?
