neighbors from hell living above us !

Posted by Tammy on October 06, 1999 at 20:56:41:

We have been living in an apt. on Long Island for 16 mos.
There have been 2 previous families living above us - we have had no problems
with either( from time to time , we would hear them , but no big deal,
everyone's noisy once in a while! we never complained)On Sept. 1st, A family moved in
,2 parents,2 boys(ages 6 & 12)& 2 nuerotic dogs - (there is also a step-sister
Age 7 or so- that's spends alot of time there, too)
At first we were on friendly terms, the woman told us that they had just moved from a house- so that the kids would need an
adjustment period to get used to living above people. And if they were too loud to just bang on our ceiling.fine.We gave them time
and banged on the ceiling when the noise became unbearable. We spoke to them in person several times. each time they got nastier & nastier
After listening to thier dog bark for over an hour, we contacted the security guard in our development. the woman became enraged &
started cursing & screamed that she hoped that the F****** ceiling comes down
on my ( this , by the way was yelled in front of my 2 yr. old). She then proceeded to jump up & down !
I called 911 , they told them to knock it off.
Ever since then, the niose has been worse than ever.
The management co. is no help whatsoever. The said that they won't evict them.
They also refuse to let us out of our lease!!

We are miserable & not a day goes by without these people stomping, stamping, jumping etc..
(At this point I know that it is being done intentionally, like I said, the other families never made anywhere near this kind of
noise)
What are my chances of getting out of my lease & getting our $3000. deposit back?
Thanks for any advice (sorry this is so long)
